There are many ways for one to commit Assault. Assault charges range from Assault in the first degree, which is a B felony and has a maximum sentence of twenty years, down to Assault in the third degree which is an A Misdemeanor and has a maximum sentence of 1 year.

Family Violence Crimes
If you are accused of any violent crime and the victim is a family member, or you are or were in any type of relationship with them, your case will be classified as Family Violence. When your case is classified as Family Violence you will be arraigned in court the morning following your arrest, or Monday morning if you are arrested over the weekend. During the arraignment you will be informed of the charges against you, the presiding Judge will advise you of your constitutional rights, and in some courts you enter a plea (ALWAYS NOT GUILTY).
If you are in custody the morning of your arraignment you will be transported to court. In the courthouse you will be interviewed by someone from the bail commissioners office so that they can make a bail recommendation. Often a public defender will come and talk to you to assist in getting your bail lowered. The Judge will set your bail and the conditions of your release. You will also be interviewed
A protective order will be issued by the court during your arraignment.
